Terms & Conditions

These Terms and Conditions (“Terms and Conditions”) govern the relationship between Elevation, The Agency LLC (“Elevation,” “we,” “us,” or “our”) and you, the purchaser or traveler (“Client” and “you/your”). By planning travel with Elevation, you agree to be bound by these Terms and acknowledge that Elevation acts solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation providers, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services (“Supplier(s)”) and is not the source or provider of the travel services.

 

These Terms include warranties, disclaimers, and exclusions of liability and may restrict your rights and remedies.

1. Use of Elevation Services

You warrant that you are at least 18 years old and have legal authority to make travel bookings with Elevation. You agree to provide accurate information, make only legitimate reservations, and comply with Supplier terms and conditions. Elevation is not responsible for arrangements made outside of our agency.

2. Right to Correct Errors / Availability

We reserve the right to correct errors and adjust pricing. All offers and Supplier promotions are subject to availability and change without notice.

3. Payments, Cancellations, and Changes

You are responsible for all charges arising from your bookings. By providing payment authorization, you permit us to process travel purchases with our Suppliers. Disputes must follow Supplier policies; chargebacks not in line with these policies may result in recovery of associated costs. Cancellation penalties will apply according to both Supplier and Elevation policies.

4. Travel Documents

You are responsible for obtaining valid passports, visas, and other required travel documents. Elevation is not responsible for denied boarding or entry due to documentation issues.

5. Entry & Exit Requirements

Entry rules vary by country. It is your responsibility to determine eligibility for travel to each destination.

6. Health Requirements

You are responsible for meeting all health, vaccination, and screening requirements. Check the CDC and State Department websites for the latest information.

7. Risks & Safety

Travel may involve risks. You should review U.S. State Department advisories and register with STEP for international trips. Travel to a destination offered by Elevation does not imply it is without risk.

8. Hazardous Materials

Federal law prohibits carrying hazardous materials on flights.

9. Insecticide Notice

Some countries require aircraft to be treated with insecticides. See DOT for details.

10. Air Travel

Airline tickets are contracts between you and the airline. Elevation is not responsible for airline performance, schedule changes, or refund policies.

11. Limitations of Responsibility

Elevation acts solely as an agent for Suppliers and is not liable for acts, errors, omissions, or negligence of Suppliers or their employees. Any recovery from Elevation is limited to the commission and fees actually received by us.

12. Force Majeure

We are not liable for non-performance caused by events beyond our control, including acts of God, terrorism, pandemics, or government actions. Travel insurance is strongly recommended.

13. Client Conduct

You are responsible for any damage caused during travel and for complying with all laws.

14. Currency Fluctuations

Prices may change due to currency exchange rate fluctuations.

15. Travel Insurance

We strongly recommend purchasing travel insurance to protect your investment. Without it, you may lose nonrefundable amounts.

16. Changes to These Terms

We may update these Terms at any time. The most current version will be posted on our website.

17. Governing Law

These Terms are governed by the laws of the State of New York. You consent to the exclusive jurisdiction of courts in New York County, New York.

 

By booking travel with Elevation, The Agency LLC, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
